By using the services provided by First House Publishing (hereinafter “the Company”), including but not limited to manuscript reviews, consulting, and publishing packages, you (the “Client”) agree to be bound by these terms.
2. Limitation of Liability (Crucial)
To the maximum extent permitted by applicable law, First House Publishing shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with the use of our services.
Content Responsibility: The Client remains solely responsible for the legality, accuracy, and copyright of their manuscripts and published works. The Company does not assume any liability for claims of plagiarism, defamation, or copyright infringement.
Third-Party Damage: The Company is not liable for any damage, loss, or claims caused by or to third parties (including but not limited to distributors, printers, or readers) resulting from the Client’s work.
No Guarantees: While the Company strives for excellence, we provide no guarantees regarding sales, commercial success, or literary awards. Services are provided “as is” without warranties of any kind.
3. Indemnification
The Client agrees to indemnify and hold First House Publishing, its employees, and affiliates harmless from any claims, losses, or expenses (including legal fees) arising from the Client’s breach of these terms or any third-party claims related to the Client’s content.
4. Data Collection & Privacy
We value your privacy. In accordance with global data protection standards (such as GDPR):
Data We Collect: We collect your name, email address, and payment details solely for the purpose of processing your order and communicating regarding your project.
Payment Security: Payments are processed via Stripe. We do not store your credit card information on our servers.
Data Sharing: We never sell your personal data to third parties. We only share information with third-party service providers (like Stripe) as necessary to complete your transaction.
5. Intellectual Property
Unless otherwise agreed in writing, the Client retains all intellectual property rights to their manuscript. The Company retains rights to any proprietary tools, branding, or methods used during the service process.
6. Governing Law
These terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the exclusive jurisdiction of the Dutch courts.
